Corey & Jennifer WashingtonWashington George Volandes PLLC

You moved. Does your estate plan still work here?

Your will likely did not stop being valid when you crossed a state line. But it was written for the place you left. We review plans for people who have moved to New York or Georgia from anywhere, then quote a fixed fee for any updates.

What a move can change

Your powers of attorney

Banks can be slow to accept a form from another state. The person you named may need your documents most when you can no longer sign new ones.

Your health care documents

Hospitals work most easily with forms they know. New York uses a health care proxy, and Georgia uses an advance directive.

Your executor and trustee

Each state has its own rules and court process, and the person you chose may now live far from you.

What your spouse may claim

New York and Georgia protect surviving spouses in different ways, and both differ from many other states.

Estate tax

New York has its own estate tax. Georgia does not. The state you left may still tax property you kept there.

Property from a community property state

If you lived in a state such as California or Texas, what you acquired there may need special attention.

Still tied to two states?

Corey and Jennifer are each admitted in New York and Georgia, which helps when your home, family or business is in both.

What if I own property in both states?

Real estate outside your home state can mean a separate court proceeding there. Planning ahead can reduce that burden.

Can New York still tax my estate after I move to Georgia?

It can. New York may tax New York real property owned by a nonresident, and your residency facts matter. Read the guide.
