Moving From New York to Georgia? Review Your Estate Plan

A move does not automatically cancel your estate plan, but it is one of the best reasons to review it.

Your documents

Your will, trust, power of attorney and health care documents were written with one state's law and practice in mind. Banks, hospitals and courts in your new state may treat them differently, so have each document reviewed.

Your property

If you keep a New York home after moving to Georgia, your family may need a separate court proceeding in New York. New York may also tax New York real property owned by a nonresident.

Your residency

Moving your home is more than changing an address. Where you spend your time, vote, keep your belongings and maintain your life can all matter if your residency is questioned.

Your people

Revisit whom you named as executor, trustee, guardian and health care agent. The right person when you lived nearby may not be the right person from 750 miles away.
